Martin N. Refkin

Martin Refkin has over 36 years of trial experience in a broad spectrum of matters including toxic torts, CERCLA, RCRA, real estate, general business litigation, insurance recovery and personal injury. He has tried cases in venues throughout California.

Martin was lead attorney in Frank Babich, et al. v. Cadillac Fairview/California, et al., Guillermo C. Aguirre v. Cadillac Fairview/California, et al., and Paul Kidwell v. Montrose Chemical, et al. (U.S.D.C., Central District of California). These cases were all toxic tort matters related to the Del Amo Superfund site in Los Angeles County. Martin was also lead counsel in Abel, et al. v. Lockheed, et al. in which approximately 3500 plaintiffs were claiming injuries due to exposure to contaminants via drinking water and the air. In another environmental case, Carson Harbor Village v. Unocal (Compton), Martin was lead counsel and obtained a summary judgment in federal court after conducting extensive discovery. The Carson Harbor Village case is a landmark appellate decision, cited frequently for a variety of environmental rules of law.

Martin was the lead attorney for Frontier Oil Corporation and Wainoco Oil and Gas Company in the consolidated cases styled Moss, et al. v. City of Beverly Hills, et al. Here, over 1000 plaintiffs sued several oil companies, the City of Beverly Hills and the Beverly Hills Unified School District claiming that their exposure to benzene and other chemicals allegedly coming from the oil field on school property caused their cancers.

Martin was the firm's lead attorney in Adame v. State of California, in which over 135 plaintiffs sued the State of California (our client) and others in a toxic tort action, claiming exposure to a variety of chemicals has caused cancer and other illnesses.

Martin has extensive experience handling personal injury matters.  He has successfully settled or tried hundreds of personal injury cases, many of which involved serious injuries or wrongful death.

Martin has represented surety companies and general contractors in construction defect cases.  He also has extensive experience in all types of commercial real estate litigation, including breach of contract and unlawful detainer matters.

Currently, Martin is the lead trial attorney in City of Rialto, et al. v. United States Department of Defense, et al. (consolidated cases), representing the County of San Bernardino in both federal and state court litigation involving perchlorate and TCE contamination in the Rialto-Colton Basin. He is also the lead attorney in the Orange County Water District v. Northrop Corporation, et al. case. This matter is venued in the Complex Litigation Section of the Orange County Superior Court and involves TCE and PCE contamination in both soil and groundwater. In the case of Atlantic Richfield Company v. State of California, et al., Martin is the lead attorney defending the California State Water Resources Control Board and the Lahontan Regional Water Quality Control Board in a lawsuit concerning the Leviathan Mine Superfund Site. This case involves a contaminated mine site that threatens water quality in both California and Nevada.
